RECORD OF PROCEEDINGS AIR FORCE BOARD FOR CORRECTION OF MILITARY RECORDS IN THE MATTER OF: DOCKET NUMBER: BC-2014-01105 COUNSEL: NONE HEARING DESIRED: NO APPLICANT REQUESTS THAT: His Home Of Record (HOR) be changed from XXXXXXXXXX to XXXXXXXXXX. APPLICANT CONTENDS THAT: He misunderstood the definition of HOR at the time of commissioning. XXXXXXXXXX, was his correct HOR and the place he resided for almost two years prior to commissioning at the University of XXXXXXXXXX Y, after graduating from Air Force Reserve Officer Training Corps (AFROTC). He is a registered voter in XXXXXXXXXX and has always maintained a XXXXXXXXXX driver’s license while on active duty. The applicant’s complete submission, with attachments, is at Exhibit A. STATEMENT OF FACTS: On 10 Jun 01, the applicant initially entered the Regular Air Force. On 11 May 91, the applicant listed XXXXXXXXXX as his HOR in Block 6 of AF Form 24, Application for Appointment as Reserve of the Air Force or USAF Without Component, and his personal mailing address as XXXXXXXXXX. On 10 Mar 13, the applicant was furnished an honorable discharge, and was credited with 11 years, 9 months, and 1 day of active service. According to his DD Form 214, his place of entry into active duty reflects XXXXXXXXXX but his HOR is reflected as XXXXXXXXXX. The remaining relevant facts pertaining to this application, are described in the memorandum prepared by the Air Force office of primary responsibility (OPR), which are included at Exhibits C. AIR FORCE EVALUATION: AFPC/DPSIPS recommends denial, indicating there is no evidence of an error or injustice. The Joint Federal Travel Regulation identifies the HOR as the location identified by the individual upon entering the service, not a location where the individual is later assigned or a location selected for convenience; a correction must be fully justified. Domicile or legal residence may change, but the HOR will not. The applicant’s AF Form 24, Application for Appointment as Reserve of the Air Force or USAF Without Component, and AF Form 766, Extended Active Duty Order, list XXXXXXXXXX, as his HOR. A complete copy of the AFPC/DPSIPS evaluation is at Exhibit C. APPLICANT'S REVIEW OF AIR FORCE EVALUATION: The applicant does not deny XXXXXXXXXX is documented as his HOR in his official military records. He is not seeking the change to gain entitlements, but to make his record as accurate as possible. He reiterates he was misinformed [prior to completing the AF Form 24] and lists several pieces of source documentation to prove residency in XXXXXXXXXX prior to commissioning (Exhibit E). THE BOARD CONCLUDES THAT: 1. The applicant has exhausted all remedies provided by existing law or regulations. 2. The application was timely filed. 3. Sufficient relevant evidence has been presented to demonstrate the existence of an error. We took notice of the applicant's complete submission, to include his rebuttal response to the advisory opinion, in judging the merits of the case. While the Board notes the comment from AFPC/DPSIPS that the applicant willfully listed XXXXXXXXXX, as his HOR, we believe the information provided in the applicant’s request clearly establishes XXXXXXXXXX, as his actual home for many years prior to his initially entering the service. In this respect we note the applicant has provided a letter from the university he attended while at ROTC, and an Air Force Leave and Earning Statement documenting he was living in XXXXXXXXXX for the two years leading up to his accession. As a result, we find it highly likely that the applicant erroneously reported his HOR as P XXXXXXXXXX, when, for all practical intents and purposes, his HOR was XXXXXXXXXX. Therefore, we recommend the applicant’s record be corrected as indicated below. THE BOARD RECOMMENDS THAT: The pertinent military records of the Department of the Air Force relating to the APPLICANT be corrected to show that his official home of record (HOR) is “XXXXXXXXXX,” instead of “XXXXXXXXXX.” The following members of the Board considered AFBCMR Docket Number BC-2014-01105 in Executive Session on 17 Dec 14 under the provisions of AFI 36-2603: , Panel Chair , Member , Member All members voted to correct the records as recommended.
